The appeal from the judgment of the Federal Court of Appeal, 2008 FCA 209, Numbers A‑478‑07, A‑479‑07, dated June 13, 2008, heard on October 16, 2009, is allowed with costs throughout on a party and party basis. The application for judicial review is allowed and a declaration issued that the responsible authorities erred in failing to use the project as proposed by Red Chris Development Company Ltd. to determine whether the Canadian Environmental Assessment Act was triggered under s. 5 of the Act, whether the Exclusion List Regulations, 2007 applied, and if a federal environmental assessment was to be conducted, whether it was to proceed by way of comprehensive study if the project was listed in the Comprehensive Study List Regulations and if not, by way of screening.
L’appel interjeté contre l’arrêt de la Cour d’appel fédérale, 2008 CAF 209, numéros A‑478‑07, A‑479‑07, en date du 13 juin 2008, entendu le 16 octobre 2009, est accueilli avec dépens devant toutes les cours sur la base partie-partie. La demande de contrôle judiciaire est accueillie et un jugement est rendu déclarant que les autorités responsables ont fait erreur en ne considérant pas le projet tel que proposé par Red Chris Development Company Ltd. pour déterminer si l’application de la Loi canadienne sur l’évaluation environnementale était déclenchée en vertu de l’art. 5 de cette loi, si le Règlement de 2007 sur la liste d’exclusion s’appliquait et s’il y avait lieu d’effectuer une évaluation environnementale fédérale, par une étude approfondie si le projet était visé par le Règlement sur la liste d’étude approfondie, sinon par un examen préalable.
