Communications law ‑ Broadcasting ‑ Reference ‑ Whether retail internet service providers (“ISPs”) carry on, in whole or in part, “broadcasting undertakings” subject to the Broadcasting Act when, in their role as ISPs, they provide access through the Internet to “broadcasting” requested by end‑users ‑ Whether the Federal Court of Appeal erred in law in its interpretation of the word “transmission” in s. 2 of the Broadcasting Act ‑ Whether the Federal Court of Appeal erred in holding that retail ISPs do not carry on “broadcasting undertakings” by reason of policy or considerations other than the wording of s. 2 of the Broadcasting Act ‑ Broadcasting Act, S.C. 1991, c. 11.
The Canadian Radio‑television and Telecommunications Commission applied to the Federal Court of Appeal for a reference to determine the status of Internet service providers (“ISPs”.) The question was: Do retail ISPs carry on, in whole or in part, “broadcasting undertakings” subject to the Broadcasting Act, S.C. 1991,c. 11 when, in their role as ISPs, they provide access through the Internet to “broadcasting” requested by end‑users? The appellants took the position that the answer should be in the affirmative while the Respondents submitted that it should be answered in the negative.

Droit des communications ‑ Radiodiffusion ‑ Renvoi ‑ Les fournisseurs de services Internet (« FSI ») de détail exploitent‑ils, en tout ou en partie, des « entreprises de radiodiffusion » assujetties à la Loi sur la radiodiffusion, lorsque, conformément à leur rôle comme FSI, ils fournissent l’accès par Internet à la « radiodiffusion » demandée par les utilisateurs finaux? ‑ La Cour d’appel fédérale a‑t‑elle commis une erreur de droit dans son interprétation de l’art. 2 de la Loi sur la radiodiffusion? ‑ La Cour d’appel fédérale a‑t‑elle eu tort de statuer que les FSI de détail n’exploitent pas des « entreprises de radiodiffusion » en raison de politiques ou de considérations autres que l’article 2 de la Loi sur la radiodiffusion? ‑ Loi sur la radiodiffusion, L.C. 1991, ch. 11.
Le Conseil de la radiodiffusion et des télécommunications canadiennes a présenté une demande de renvoi à la Cour d’appel fédérale. Dans le cadre de ce renvoi, il a demandé à la Cour d’appel fédérale de déterminer le statut des fournisseurs de services Internet. La question posée dans le cadre de ce renvoi était la suivante : Les fournisseurs de services Internet de détail exploitent‑ils, en tout ou en partie, des « entreprises de radiodiffusion » assujetties à la Loi sur la radiodiffusion, L.C. 1991, ch. 11, lorsque, conformément à leur rôle comme FSI, ils fournissent l’accès par Internet à la « radiodiffusion » demandée par les utilisateurs finaux? Les appelantes ont prétendu que la réponse à la question devrait être affirmative alors que les intimées ont prétendu qu’elle devrait être négative.
