The appeal from the judgment of the Court of Appeal for Ontario, Number C48807, 2010 ONCA 133, dated February 19, 2010, heard on May 17, 2011, is allowed, the acquittal is set aside and a new trial is ordered. Binnie, LeBel and Fish JJ. are dissenting.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C48807, 2010 ONCA 133, en date du 19 février 2010, entendu le 17 mai 2011, est accueilli, l’acquittement est annulé et la tenue d’un nouveau procès est ordonnée. Les juges Binnie, LeBel et Fish sont dissidents.
