The appeal from the judgment of the British Columbia Supreme Court, Number 23900, 2008 BCSC 211, dated February 22, 2008, heard on November 18, 2011, is dismissed but subparas. 1 through 6 of the trial judge’s order, found at para. 454 of his reasons, are set aside. Section 184.4 of the Criminal Code is declared unconstitutional. The declaration of invalidity is suspended for a period of 12 months.
L’appel interjeté contre le jugement de la Cour suprême de la Colombie-Britannique, numéro 23900, 2008 BCSC 211, en date du 22 février 2008, entendu le 18 novembre 2011, est rejeté mais les conclusions 1 à 6 de l’ordonnance figurant au par. 454 des motifs du juge du procès sont annulées. L’article 184.4 du Code criminel est inconstitutionnel. La prise d’effet de cette déclaration d’invalidité est suspendue pour une période de 12 mois.
