The appeal from the judgment of the Court of Appeal of Quebec (Québec), Number 200-10-002302-086, 2010 QCCA 2237, dated December 3, 2010, heard on December 16, 2011, is allowed and the trial judge’s verdict is restored. LeBel and Fish JJ. are dissenting.
