The appeal from the judgment of the Court of Appeal for Ontario, Number C48500, 2011 ONCA 143, dated February 24, 2011, heard on March 16, 2012, is allowed, the order for a new trial set aside and the guilty verdict on the charge of dangerous driving causing bodily harm restored. LeBel, Fish and Cromwell JJ. are dissenting.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C48500, 2011 ONCA 143, en date du 24 février 2011, entendu le 16 mars 2012, est accueilli, l’ordonnance prescrivant la tenue d’un nouveau procès est annulée, et la déclaration de culpabilité quant au chef de conduite dangereuse causant des lésions corporelles est rétablie. Les juges LeBel, Fish et Cromwell sont dissidents.
