The appeal from the judgment of the Court of Appeal of Alberta (Edmonton), Number 0903-0328-AC, 2011 ABCA 55, dated February 16, 2011, heard on November 15, 2012, is allowed. The judgment of the Alberta Court of Appeal is set aside and the judgment of the Court of Queen’s Bench is restored, with costs to the appellant.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Alberta (Edmonton), numéro 0903-0328-AC, 2011 ABCA 55, en date du 16 février 2011, entendu le 15 novembre 2012, est accueilli. L’arrêt de la Cour d’appel de l’Alberta est annulé et le jugement de la Cour du Banc de la Reine est rétabli, avec dépens en faveur de l’appelante.
