The appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Number CA037058, 2011 BCCA 253, dated May 30, 2011, heard on December 4, 2012, is allowed with costs to the appellant throughout. The parties’ appeal and cross-appeal on the trial judge’s damages award are remitted to the Court of Appeal to consider that issue.
L’appel interjeté contre l’arrêt de la Cour d’appel de la Colombie-Britannique (Vancouver), numéro CA037058, 2011 BCCA 253, en date du 30 mai 2011, entendu le 4 décembre 2012, est accueilli avec dépens en faveur de l’appelante devant toutes les cours. L’appel et l’appel incident des parties sur la question des dommages-intérêts accordés par la juge de première instance sont renvoyés à la Cour d’appel pour examen.
