The appeal from the judgment of the Court of Appeal for Ontario, Number C53442, 2011 ONCA 482, dated June 29, 2011, heard on December 10, 2012, is dismissed without costs. The motions to adduce fresh evidence are dismissed without prejudice to the Consent and Capacity Board receiving any evidence it deems relevant. Abella and Karakatsanis JJ. are dissenting.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C53442, 2011 ONCA 482, en date du 29 juin 2011, entendu le 10 décembre 2012, est rejeté sans dépens. Les requêtes en vue de présenter de nouveaux éléments de preuve sont rejetées, sans préjudice à la possibilité que la Commission du consentement et de la capacité reçoive tout élément de preuve qu’elle jugera pertinent. Les juges Abella et Karakatsanis sont dissidentes.
